PREAMBLE
These general terms and conditions of sale (hereinafter the “GTC”) apply to all distance orders placed by a consumer with BODYSCULPTOR (hereinafter the “Seller”) for all products offered on the website https://www.bodysculptor.fr (hereinafter the “Website”).
A consumer means “any natural person acting for purposes which are outside their trade, business, craft, liberal profession or agricultural activity” (preliminary article of the French Consumer Code). Professionals wishing to purchase BODYSCULPTOR products are invited to contact the Seller: sales to professionals are governed by specific terms. Since 1 October 2026, professional BODYSCULPTOR devices have been distributed in metropolitan France exclusively by HOLICARE, the official distributor. Requests sent to the Seller concerning these devices are forwarded to HOLICARE, and their sale is governed by HOLICARE’s terms of sale.
The GTC are brought to the buyer’s attention before the order is placed and are accessible at any time on the Website. The buyer may save or print them.
The applicable GTC are those in force on the date the order is confirmed. The buyer declares that they have read and accepted them, by ticking a box, before confirming their order.
ARTICLE 1 – PRODUCTS
1.1. In accordance with Articles L.111-1 and L.221-5 of the French Consumer Code, the buyer may, before placing an order, consult on the Website the essential characteristics of the product(s) they wish to order.
1.2. Products are offered while stocks last.
1.3. The BODYSCULPTOR devices offered on the Website are non-medical aesthetic devices for home use. They are not intended to diagnose, prevent or treat any disease. The general information published on the Website (articles, advice, editorial content) is provided for guidance only and does not replace the advice of a healthcare professional. This reservation does not apply to the essential characteristics of the products, which are binding on the Seller.
1.4. Before any use, the buyer must read the user manual supplied with the device, in particular the contraindications and precautions for use it contains. This user manual is provided with each device in the form of a leaflet allowing it to be downloaded via a QR code.
1.5. The Seller reserves the right to change the range of products available on the Website at any time, without affecting orders already confirmed.
ARTICLE 2 – PRICES AND DELIVERY CHARGES
2.1. The applicable prices are those displayed on the Website when the order is confirmed. The Seller may change its prices at any time; any change has no effect on orders already confirmed.
2.2. Prices are shown in euros, all taxes included, including the VAT applicable on the date of the order.
2.3. Prices do not include delivery charges, which are invoiced in addition and shown in the order summary before confirmation. They are as follows:
Metropolitan France: free delivery for purchases of €150 incl. VAT or more; €10 incl. VAT below that amount;
Europe (countries served, see Article 6.1): €30 incl. VAT for any order under €500 incl. VAT; free delivery above that amount;
Rest of the world: €80 incl. VAT for any order under €500 incl. VAT; free delivery above that amount.
2.4. For deliveries outside the European Union, any customs duties, import taxes and customs clearance fees are not included in the price. They are payable by the buyer, who is deemed to be the importer of the products. The buyer is advised to check with the authorities of their country.
ARTICLE 3 – ORDERS
3.1. The buyer selects the products of their choice and adds them to their cart, the contents of which can be changed at any time in the “My cart” section.
3.2. The buyer enters their billing and delivery details, then accesses an order summary (products, quantities, prices incl. VAT, delivery charges, delivery time) allowing them to check the details and correct any errors.
3.3. After accepting the GTC, the buyer confirms the order by clicking the “Order with obligation to pay” button. The contract is concluded upon receipt of payment by the Seller, subject to the provisions of Article 5.2.
3.4. The buyer is bound by the information they provide. The Seller cannot be held liable if delivery is impossible due to an error by the buyer in their delivery details.
ARTICLE 4 – PAYMENT
4.1. The price is payable in full when the order is placed.
4.2. Payment is made online by bank card (CB, Visa, Mastercard, American Express) via the secure Stripe payment solution (see Article 9.4).
4.3. The order is definitively confirmed once payment has been accepted. It may only be called into question in the cases provided for by law and by these GTC, in particular under the right of withdrawal (Article 8).
ARTICLE 5 – ORDER CONFIRMATION AND ARCHIVING
5.1. The Seller sends the buyer an order confirmation by email to the address given when ordering. This confirmation sets out the essential characteristics of the products, the price, the delivery charges, the delivery time and these GTC.
5.2. The Seller reserves the right to refuse or cancel an order for a legitimate reason, in particular in the event of a previous dispute concerning payment for an order, suspected fraud, quantities that are abnormal for personal use, or product unavailability. It informs the buyer within five (5) working days. Any amounts debited are then refunded in full within fourteen (14) days at the latest.
5.3. For any order of €120 incl. VAT or more, the Seller keeps the written record of the contract for ten (10) years from delivery and guarantees the buyer access to it on request sent to in**@**********or.fr. The buyer is advised to keep the order confirmation on paper or in digital form.
ARTICLE 6 – DELIVERY
6.1. Delivery areas: for products for home use, the Website delivers to metropolitan France, to European Union countries and to the rest of the world, with the exception of Belgium, Luxembourg and the Netherlands. In accordance with Regulation (EU) 2018/302, a consumer residing in one of these three countries may nevertheless order on the Website for delivery to an address located in an area served.
6.2. Delivery is made by the carrier chosen by the Seller, by handing the product to the recipient designated by the buyer, against signature. The buyer is advised to check the condition of the parcel in the presence of the delivery person and, in the event of any anomaly (opened or damaged parcel, missing or damaged product), to note precise reservations on the delivery slip and inform the Seller as soon as possible at in**@**********or.fr. The absence of reservations does not deprive the buyer of their rights under the legal guarantee of conformity.
6.3. Delivery time: unless otherwise stated on the Website, products are delivered within ten (10) working days of order confirmation and, in any event, within a maximum of thirty (30) days of the conclusion of the contract. The applicable delivery time is stated in the order summary and in the order confirmation.
6.4. Late delivery: if the delivery time is exceeded, the buyer may, after having requested the Seller to deliver within a reasonable additional period which has not been met, terminate the contract by registered letter with acknowledgement of receipt or in writing on another durable medium (Article L.216-6 of the French Consumer Code). The Seller then refunds all sums paid within fourteen (14) days of termination at the latest.
6.5. Out of stock: in the event of an exceptional stock shortage, the buyer is informed by email or telephone. They may choose either to postpone delivery until the product is back in stock or to cancel their order; in the latter case, they are refunded in full within fourteen (14) days at the latest.
6.6. In accordance with Article L.221-15 of the French Consumer Code, the Seller is automatically liable for the proper performance of the contract. It may be released from all or part of its liability by proving that the non-performance or improper performance is attributable either to the buyer, or to the unforeseeable and insurmountable act of a third party to the contract, or to force majeure within the meaning of Article 1218 of the French Civil Code.
6.7. In accordance with Article L.216-4 of the French Consumer Code, the risk of loss of or damage to the products passes to the buyer when the buyer, or a third party designated by them other than the carrier proposed by the Seller, takes physical possession of the products.
ARTICLE 7 – LEGAL GUARANTEES AND AFTER-SALES SERVICE
7.1. Legal guarantees
All products sold on the Website benefit from the legal guarantee of conformity (Articles L.217-1 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code), under the conditions set out below.
The buyer may submit a claim by email to in**@**********or.fr or by post to BODYSCULPTOR S.A.S., 26 rue d’Armaillé, 75017 Paris (France), stating their order number and the nature of the defect.
Information on the legal guarantee of conformity and the guarantee against hidden defects (Article D.211-2 of the French Consumer Code)
The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity obliges the professional, where applicable, to provide all updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if: 1° the professional refuses to repair or replace the goods; 2° the repair or replacement takes place after a period of thirty days; 3° the repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods; 4° the lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The rights mentioned above result from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.
A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L.241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
7.2. Handling of BODYSCULPTOR devices
A) To enable their request to be processed, the buyer is asked to provide their invoice or order confirmation and, where applicable, the serial number of the device. The absence of these documents does not deprive the buyer of their rights if they can prove their purchase by any other means.
B) The Seller informs the buyer of how to return the device. Under the legal guarantee of conformity, the goods are brought into conformity free of charge for the buyer, including return and reshipping costs. It is recommended that the device be returned in packaging that effectively protects it, preferably its original packaging.
C) Replaced parts become the property of the Seller.
D) The following do not constitute a lack of conformity: damage resulting from
use not in accordance with the user manual, misuse or an accident;
exposure to excessive humidity, liquid, extreme thermal or environmental conditions, corrosion or chemicals;
modifications, connections or repairs carried out by the buyer or by an unauthorised repairer, or with non-original parts;
an unsuitable power supply or incorrect installation;
use with an accessory not manufactured or supplied by the Seller;
normal wear and tear of parts and consumables.
E) In accordance with Article L.111-4 of the French Consumer Code, spare parts essential to the use of BODYSCULPTOR devices are available for three (3) years from the date of purchase.
7.3. Other products sold on the Website
Other products sold on the Website, in particular OsmoSculpt Hydrogels, benefit from the legal guarantees set out in Article 7.1. In the event of a defect, the buyer contacts the Seller at in**@**********or.fr; the product is replaced or refunded, at the buyer’s choice and under the conditions provided for by law, free of charge for the buyer.
ARTICLE 8 – RIGHT OF WITHDRAWAL
8.1. Period: in accordance with Article L.221-18 of the French Consumer Code, the buyer has fourteen (14) days from receipt of the products to exercise their right of withdrawal, without having to give reasons or bear any costs other than those provided for below. Where several products are ordered and delivered separately, the period runs from receipt of the last product. The buyer may exercise this right as soon as the contract is concluded. If the period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.
8.2. Exercise: the buyer notifies their decision before the period expires, using the model withdrawal form in the appendix, the online “Customer service” form on the Website, by email to in**@**********or.fr, or by any other unambiguous statement. The Seller acknowledges receipt without delay on a durable medium.
8.3. Return of products: the buyer returns the products, complete (including accessories and instructions), without undue delay and no later than fourteen (14) days after communicating their decision, to the following address: BODYSCULPTOR – Route de la Gare – Bâtiment 5 – CD 155 – 78890 Garancières (France). The direct costs of return are borne by the buyer. Parcels sent carriage forward or cash on delivery are not accepted. It is recommended that products be returned securely, with a declared value corresponding to the purchase price, and that proof of shipment be kept.
8.4. Refund: the Seller refunds all sums paid, including standard delivery charges, no later than fourteen (14) days from the date on which it is informed of the decision to withdraw. It may withhold the refund until it has received the products back or until the buyer has provided proof of having sent them, whichever is earlier. The Seller is not required to refund additional costs if the buyer expressly chose a more expensive delivery method than the standard method offered. The refund is made using the same means of payment as that used for the order, unless the buyer expressly agrees to another means that does not incur any costs for them.
8.5. Condition of products: the buyer is only liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning (Article L.221-23 of the French Consumer Code). Any device returned incomplete, damaged, soiled or showing signs of use beyond a simple trial may be subject to a deduction corresponding to its loss in value.
8.6. Exception: in accordance with Article L.221-28, 5° of the French Consumer Code, the right of withdrawal cannot be exercised for cosmetic products, in particular OsmoSculpt Hydrogels, which have been unsealed by the buyer after delivery and cannot be returned for reasons of hygiene or health protection. Unopened products in their original sealed packaging remain subject to the right of withdrawal.

The data is kept for the duration of the contractual relationship, then for three (3) years from the last contact for marketing purposes; accounting records are kept for ten (10) years.
9.4. Payment: online payment is handled by the secure payment service provider Stripe. Bank card data is sent directly to Stripe in encrypted form; the Seller has no access to it and does not store it.
9.5. Rights: in accordance with Regulation (EU) 2016/679 (GDPR) and the amended French Data Protection Act No. 78-17 of 6 January 1978, the buyer has the right of access, rectification, erasure, restriction, portability and objection, as well as the right to set instructions regarding what happens to their data after their death. 10.4. Mediation is not compulsory. Failing an amicable settlement, the dispute may be brought before the competent courts in accordance with the ordinary rules of law.
